Despite having the Department of Elections return his filing fee, one Democratic candidate for mayor of Wilmington says, he's still in the race.

As dozens of supporters chanted "Run D, run," Pastor Derrick Johnson said he's not ready to walk away from his run for mayor.
Johnson says the department returned his filing fee after an opinion from the Attorney General's office stated his past crimes prohibit him from holding public office.
But Johnson says an opinion is merely that, and he wants a firm decision from an authority higher than the Justice Department.

"We're calling upon the Governor to certify this to the Delaware Supreme Court for the question to have the term "infamous" defined not by an opinion from the state's attorney's office, but rather from the judiciary where it should be."
And Johnson says he's still running until the court tells him he can't.

"If the court says I can't, then I'm out, period. And I believe that the Board of Elections violated my rights by saying, 'We took the opinion of the Deputy Attorney General.'"
