Sussex County says its position hasn't changed, even in light of a civil complaint filed by Sheriff Jeffrey Christopher...sheriffs and their deputies in Delaware are not law enforcement officers and are not empowered with arrest authority.

Christopher has filed a civil complaint in the Delaware Superior Court for Sussex County, asking the court to determine the scope of the sheriff's authority.

Christopher believes the sheriff's office has the right to enforce the law.

While the complaint has been filed, the county has not been served official notice.
