Del. court OK's challenge to hospital approval

The state's highest court has ruled in favor of a Middletown nursing home operator that challenged a state board's approval of a similar facility in the same area.

The justices on Wednesday overruled a Superior Court finding that Broadmeadow Investment LLC did not have standing to challenge last year's approval by the Delaware Health Resources Board of HealthSouth's application for a 34-bed rehabilitation hospital near Broadmeadow's 120-bed Middletown facility.

Approval of the HealthSouth facility followed accusations of political meddling by Gov. Jack Markell, who pushed for the project even though a review committee of the Health Resources Board recommended against it.

The project was approved only after Markell replaced two members of the review committee and several other members of the Health Resources Board, including its chairman, resigned in protest.
