Del. man charged with 5th drunken driving offense

Police say a 50-year-old Harrington man has been arrested for the fifth time on a drunken driving offense after he was found passed out at the wheel of a car with the motor running.

Harrington's Deputy Chief Keith Shyers says officers called to investigate a report of a suspicious vehicle on Monday night found 50-year-old Jerry Legates asleep with the motor running.

He says Legates was arrested Monday and charged with driving under the influence. He was also charged with failure to comply with taking photos and fingerprints and failure to have insurance.

Police say Legates was taken to police headquarters where he failed a sobriety test. He was taken to Sussex Correctional Institution where he was ordered held in default of bond.
