Superior Court judge to step down

New Castle County Superior Court Judge John Babiarz Jr. says he will not seek a third term when his current term expires this month.

Babiarz notified Gov. Markell of his decision in a letter.

Markell will name a successor, who must be a Democrat to maintain political balance on the bench. That person must be approved by the state Senate.

The 68-year-old Babiarz is the state's longest-serving Superior Court judge. He was appointed in 1985 and reappointed in 1997.

A spokesman for Markell says Babiarz has agreed to stay on until his replacement is seated.
