Accused killer gets new trial

A man whose conviction and death sentence for the killing of a University of Delaware student were overturned by Delaware's Supreme Court has a new trial date.
A judge Wednesday scheduled the trial for 39-year-old James Cooke to begin Feb. 22,
2011.
Cooke was convicted of killing UD student Lindsey Bonistall of White Plains, N.Y., in
2005.
Investigators said he broke into her off-campus apartment and raped and strangled her
before setting the
apartment on fire.
The state Supreme Court ruled last year that Cooke's right to a fair trial was
violated because his lawyers, against his
wishes, sought a verdict of guilty but mentally ill.
The U.S. Supreme Court last month rejected the state's appeal of that ruling.
