Former Deputy State Treasurer Erika Benner's request to return to the merit system has been denied, state officials said Friday

The Office of Management and Budget says former deputy state treasurer Erika Benner, who resigned after misuse of her state credit card won't be allowed to return to a guaranteed state job in another department.

State treasurer Chip Flowers had no direct comment on the decision by the Office of Management and Budget, but said he was concerned that budget officials continue to make public statements regarding confidential personnel matters.

"This is a political football and we understand that there's a need to use this to tarnish the image of the treasury," Flowers said.

Despite the decision, Benner remains on the treasury payroll and is on administrative leave after the recent termination of several months of medical leave.
