A 36-year-old Delaware City man was charged with assaulting a man arguing with Newark restaurant employees, knocking the victim unconscious and causing a serious head injury, according to city authorities. 

According to Newark Police, the victim was smoking with a friend outside a restaurant in the 800 block of South College Avenue around 9 p.m. on October 4, 2019, when he had an interaction with a member of the restaurant staff. 

The victim was advised he wouldn't be let back in the restaurant, and when he began to "exchange words" with one of the employees, police said Eric Brittingham struck the victim in the back of the head, knocking the victim unconscious. 

The victim left the scene, then went to an area hospital the following day after showing signs of an injury. The victim underwent emergency surgery at that time. 

Brittingham was identified by witness statements and surveillance footage, and was located on October 9, 2019, while driving under the influence of alcohol. 

Police said he was charged with first-degree assault and DUI. He was committed to the Howard R. Young Correctional Institution in lieu of $60,000 secured bond.
